Terms & Conditions

Your written proposal defines the original agreed project scope, inclusions, deliverables and price. Website package descriptions provide the starting framework, but your individual proposal records what Studio Von Terrible has specifically agreed to deliver for your project. Where the proposal differs from a general package description, the written proposal takes precedence.

The agreed scope includes only the pages, products, functionality, integrations, services and deliverables specifically included in your proposal. Work that is not listed as an inclusion should not be assumed to form part of the quoted project.

Studio Von Terrible will complete the work described in the agreed proposal. The original project is considered complete when those agreed deliverables have been completed, subject to the included revision process and final client approval.

Anything requested outside the original agreed scope is additional work and will be quoted separately or charged at the current hourly rate where agreed. A new request does not become part of the original fixed-price project simply because it is requested while the project is underway.

This includes additional pages, products, content, functionality, integrations, third-party systems, migrations, technical work, design changes, changed direction or other deliverables that were not included when the project was quoted.

The same rule applies during final testing, after the agreed work has been completed, or immediately before launch. A late request does not reopen completed work or make completion of the original project conditional on the new work being completed. Studio Von Terrible may quote or schedule the request as a separate stage of work.

Changes to work that has already been designed, developed or approved may require additional design, development, copywriting, SEO, testing or project time and may be charged separately.

Additional work may affect timing and launch dates. Studio Von Terrible is not required to absorb additional work into the original price or delay an otherwise completed project to accommodate a new request within the original timeframe.

The original project balance becomes payable when the original agreed scope is complete. New or additional work does not delay payment of that balance unless Studio Von Terrible agrees otherwise in writing.

Projects valued at $1,000 + GST or less are payable in full before work begins. Projects above $1,000 + GST require a 60% commencement payment to secure the project and begin work. The remaining 40% is due when the agreed work is complete and before final launch, transfer, handover or release of final files, unless otherwise stated in writing.

Payments are accepted by major credit card or bank deposit. Card processing or third-party payment fees, where applicable, may be added at checkout or invoicing.

Project timeframes vary depending on scope, complexity, client response times and Studio Von Terrible’s existing project schedule. Payment of your deposit secures your place in the project queue. It does not guarantee that work will commence immediately. Your anticipated commencement date will be discussed when your project is booked.

Most website projects require approximately 4 to 8 weeks from commencement, although larger or more complex projects may require longer. Any timeframe provided is an estimate rather than a guaranteed completion date.

Timely access, information, content, feedback and approvals from you are essential to keeping the project moving. Client delays may affect the completion date and, where substantial, may require the project to be rescheduled within the existing project queue.

You agree to provide the information, files, approvals, logins and access needed to complete the work. Delays in receiving these items may move the project schedule.

You are responsible for checking names, prices, dates, factual claims, legal wording, product information and other business-specific details before approval and launch.

Website builds may use a high-quality commercial theme or template as a technical foundation, then be adapted, designed and custom coded as required for the agreed project. A website described as bespoke or custom does not mean every underlying component is coded from a blank file.

Theme, app, plugin, font, licence or other third-party costs are not included unless specifically listed in your proposal. Where a paid theme is required, approval will be obtained before purchase.

Website packages include copywriting for the agreed website scope unless your proposal states otherwise. You are responsible for providing accurate source information about your business.

Existing client images and supplied photography may be used where suitable. Stock imagery, specialist asset licensing, professional photography, video production, on-site photography and other external content costs are not included unless specifically quoted.

You confirm you hold the necessary rights or permissions for material you supply.

New website builds include SEO foundations and search-aware copy within the agreed scope. This may include site structure, metadata, alt text, internal linking, schema where appropriate, technical foundations and keyword consideration.

Dedicated SEO audits, extensive keyword or competitor research, ongoing SEO campaigns, backlink work and additional SEO landing pages outside the agreed scope are separate services unless included in your proposal.

Search rankings, traffic, leads, sales and placement in search engines or AI-generated results are not guaranteed.

Website projects include up to two reasonable revision rounds unless your proposal states otherwise. Revision rounds apply to the agreed scope and are intended to refine the approved direction, not replace it with a new brief or materially expand the project.

Additional revisions, new functionality, new pages, additional products, changed direction or work requested after approval may be quoted separately.

Package page, landing page, collection and product allowances are limited to the quantities stated in your proposal. Additional content is quoted separately.

Standard additional website pages or strategic landing pages start from the current advertised rate. Pages requiring substantial custom development, integrations, specialist functionality, animation or unusually extensive content are quoted according to scope.

Hosting, domain registration, email services, Shopify subscriptions, apps, plugins, themes, licences, payment gateways and other third-party subscriptions or transaction charges are the client's responsibility unless specifically included in writing.

Third-party platforms control their own pricing, features, availability and terms. Studio Von Terrible is not responsible for outages, changes, restrictions or failures caused by those services.

Final launch, transfer or handover occurs after the final balance and any approved additional charges have been paid.

A two-week post-launch change freeze applies unless otherwise agreed. This protects the completed build while it settles into operation. Urgent faults caused by Studio Von Terrible's work will still be assessed.

After handover, Studio Von Terrible is not responsible for faults, damage or changes caused by client edits, staff, contractors, apps, plugins, third parties or unauthorised access. Repair or restoration work may be quoted separately.

Commencement payments reserve project time and cover planning and work undertaken. If you cancel after work has started, payments already made are not refundable to the extent permitted by Australian Consumer Law, subject to any rights you have under that law.

If a project is delayed or paused because required content, feedback, access or approval is not supplied, Studio Von Terrible may reschedule the remaining work around other booked projects. A substantially delayed or abandoned project may require a revised timeline or quote before work resumes.

Once all invoices relating to the agreed work are paid, you receive the rights to use the final project deliverables created specifically for your business, subject to these Terms & Conditions and any third-party licences. Ownership of Studio Von Terrible’s pre-existing intellectual property, development methods, tools, systems, templates and bespoke code is not transferred unless expressly agreed otherwise in writing.

Unless confidentiality has been agreed in writing, Studio Von Terrible may display completed work, screenshots and project outcomes in its portfolio, case studies, website, awards entries and promotional material.

Studio Von Terrible may create bespoke code, custom Liquid sections, scripts, stylesheets, animations, interactions, functionality, components, templates and other original development specifically for a project.

Unless expressly agreed otherwise in writing, Studio Von Terrible retains ownership of the underlying bespoke code and custom development. Upon full payment, the client receives a licence to use that development as part of the website or project for which it was supplied.

Bespoke Studio Von Terrible code may not be copied, extracted, reproduced, replicated, distributed, resold, repurposed, transferred to another website or project, or provided to another person or business for reuse without the express written permission of Studio Von Terrible.

Bespoke Studio Von Terrible code must not be altered, rewritten, adapted or modified by the client, their staff, contractors, developers or other third parties without the express written permission of Studio Von Terrible.

Where permission is given for a third party to modify bespoke development, all modification is undertaken at the client’s risk. Studio Von Terrible is not responsible for the subsequent functionality, appearance, performance, accessibility, compatibility, SEO performance or maintainability of modified code.

Unauthorised modification, copying, replication, distribution or reuse of bespoke Studio Von Terrible development constitutes a breach of these Terms & Conditions.

This restriction applies specifically to bespoke Studio Von Terrible development and does not prevent the client from making ordinary content changes through the website’s intended content management or Theme Editor controls, including updating text, images, products, prices, links and other settings specifically provided for client management.

Studio Von Terrible’s work involves more than the finished files, pages or website you receive. The project may draw on research, strategy, technical knowledge, development methods, workflows, systems, processes, testing, problem solving and professional experience developed by Studio Von Terrible.

Payment for a project does not transfer ownership of Studio Von Terrible’s underlying methods, processes, systems, workflows, research methods, strategic frameworks, development techniques, templates, technical solutions or professional know-how.

The client receives the rights to use the completed project deliverables as outlined in these terms, but this does not include an ongoing entitlement to Studio Von Terrible’s methods, internal processes, technical explanations, implementation instructions or future strategic advice.

Studio Von Terrible is not required to train the client, their employees, contractors or other third parties in how bespoke work was developed or how particular technical, design, SEO or strategic solutions were reached, except where specific training or documentation is included in the agreed project scope.

Any additional consultation, strategy, research, explanation, training or technical assistance requested outside the agreed scope will be treated as additional work and charged at the current Studio Von Terrible hourly rate.

Technical investigation and troubleshooting are professional services and are chargeable where they fall outside the agreed project scope.

This includes time spent diagnosing problems, researching platform limitations, investigating existing systems or code, testing possible solutions, working with third-party platforms or integrations, identifying conflicts, developing workarounds and determining how a technical issue can be resolved.

The amount of time required to implement the final solution does not determine the value or cost of the work. A solution that ultimately requires a small change may have required significant investigation, testing or specialist knowledge to identify.

Research, investigation and testing time therefore forms part of the work performed, whether or not a solution is ultimately implemented.

Where troubleshooting or technical investigation is not included in the agreed project scope, Studio Von Terrible will charge this work at the current hourly rate or provide a separate quote where appropriate.

Once a project has been handed over, the client is free to manage and update ordinary website content themselves or engage employees, contractors or other third parties to do so. This includes content and settings intentionally made available for routine client management.

This permission does not extend to the alteration, extraction, reproduction or reuse of bespoke Studio Von Terrible code or custom development, which is governed by the Bespoke Code & Custom Development section of these Terms & Conditions.

Any changes made by the client or a third party after handover are made at the client’s responsibility.

Studio Von Terrible is not responsible for errors, broken layouts, lost content, damaged functionality, accessibility issues, performance problems, SEO changes, search ranking changes, integration failures or other issues resulting from work carried out by anyone other than Studio Von Terrible.

If Studio Von Terrible is asked to investigate, repair, restore or modify work following client or third-party changes, this will be treated as new work and charged at the current hourly rate or quoted separately.

If bespoke Studio Von Terrible code or custom development is modified without written permission, Studio Von Terrible has no obligation to support, maintain, troubleshoot or restore the modified development. Any investigation, repair or restoration requested will be treated as new work and charged at the current hourly rate or quoted separately.

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

To the extent permitted by law, Studio Von Terrible is not responsible for indirect or consequential loss, lost profits, lost sales, loss of data, search ranking changes, platform outages or losses caused by third-party services, client changes or circumstances outside reasonable control.

Paying a deposit, commencement payment or invoice, approving a proposal, or instructing Studio Von Terrible to begin work confirms acceptance of the proposal and these Terms & Conditions. If a signed agreement or written proposal contains project-specific terms that conflict with this page, the project-specific written terms take precedence.
